1. Our services

HigherGrads provides education technology and recruitment support connecting students, education agents, counselors, and partner universities. Services may include programme discovery, inquiry and application submission, document collection, counselor coordination, agent onboarding, and institution partnership workflows.

HigherGrads is not a university. Admission decisions are made by partner institutions. We facilitate information, processing, and communication but do not guarantee admission, visa approval, scholarships, or employment outcomes.

2. Eligibility

You must provide accurate information and have the legal capacity to enter into these Terms. If you use our services on behalf of an organization, you confirm that you are authorized to bind that organization.

3. Accounts and portals

• Portal access is limited to authorized students, agents, institution users, and HigherGrads staff.
• You are responsible for safeguarding login credentials and all activity under your account.
• We may suspend or terminate access for security reasons, policy violations, or inactive accounts.

4. Applications, inquiries, and submissions

• You must submit truthful, complete, and current information in all forms and applications.
• Uploaded documents must be genuine and authorized for sharing with HigherGrads and relevant partners.
• Reference numbers issued after submission help track progress but do not guarantee processing timelines.
• We may reject or return incomplete submissions and request additional verification.

5. Agents, counselors, and university partners

Agents and institutions using HigherGrads products may have separate partnership agreements. Those agreements govern commissions, data handling, branding, and operational obligations in addition to these public Terms.

Students who apply through an agent acknowledge that authorized agent and counselor staff may access application data as part of the recruitment process.

6. Acceptable use

• Do not misuse the website, attempt unauthorized access, or interfere with platform security.
• Do not upload malware, unlawful content, or material that infringes intellectual property or privacy rights.
• Do not scrape, reverse engineer, or resell access to our systems without written permission.
• Do not impersonate another person or misrepresent your affiliation with an institution or agency.

7. Intellectual property

The HigherGrads name, logos, website content, product interfaces, and underlying software are owned by HigherGrads or its licensors. You may not copy, modify, or distribute our materials except as permitted for normal use of the services.

8. Third-party links and services

Our website may link to partner universities, payment providers, or external tools. We are not responsible for third-party websites, policies, or services. Your use of third-party services is subject to their terms.

9. Disclaimers

Services are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not warrant uninterrupted access, error-free operation, or that information on the website is complete for every programme or intake cycle. Always confirm final requirements with the relevant institution.

10. Limitation of liability

To the maximum extent permitted by applicable law, HigherGrads shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the services. Our total liability for any claim relating to these Terms or the services shall not exceed the amount you paid to HigherGrads for the specific service giving rise to the claim in the twelve (12) months before the claim, or MYR 500 if no fees were paid, whichever is greater.

11. Indemnity

You agree to indemnify and hold harmless HigherGrads, its officers, employees, and partners from claims arising out of your misuse of the services, breach of these Terms, or submission of inaccurate or unauthorized information.

12. Suspension and termination

We may suspend or terminate access to the website or portals at any time for breach of these Terms, legal compliance, or operational reasons. Provisions that by nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will remain in effect.

13. Governing law

These Terms are governed by the laws of Malaysia. Any dispute shall be subject to the exclusive jurisdiction of the courts of Malaysia, unless mandatory consumer protection laws in your country require otherwise.

14. Changes to these Terms

We may revise these Terms from time to time. Updated Terms will be posted on this page with a revised “Last updated” date. Continued use after changes constitutes acceptance of the updated Terms.
